SALE PROMOTION TERMS AND CONDITIONS

These Sale Promotion Terms and Conditions (“Terms”) govern your participation in any sale promotion (“Sale Promotion”) offered by Hydraform Holdings (Pty) Ltd (“Hydraform”). By participating in the Sale Promotion, you agree to be bound by these Terms.

1. SALES PROMOTION

The Sale Promotion is offered by Hydraform Holdings (Pty) Ltd (“Hydraform”), a company registered in South Africa under registration number 1994/010126/07.

2. SALE PROMOTION PERIOD

The Sale Promotion will run for the period specified in the promotional material (“Promotion Period”). Hydraform reserves the right to extend or shorten the Promotion Period at its sole discretion.

3. WHO MAY PARTICIPATE IN THE SALE PROMOTION

The Sale Promotion is open to all customers who purchase qualifying Hydraform products during the Promotion Period, unless otherwise stated in the promotional material. Employees of Hydraform and their immediate family members may be excluded from participation.

4. HOW TO QUALIFY FOR THE SALE PROMOTION

To qualify for the Sale Promotion, participants must:

i. Purchase the qualifying product(s) as specified in the promotional material during the Promotion Period;

ii. Comply with all terms and conditions set out herein;

iii. Provide proof of purchase when requested; and

iv. Meet any additional criteria specified in the promotional material.

5. CAN I QUALIFY MORE THAN ONCE FOR THE OFFER?

Unless otherwise stated in the promotional material, each qualifying purchase entitles the customer to one promotional offer. Multiple purchases may qualify for multiple offers, subject to availability and any limitations specified in the promotional material.

6. OFFER

a. The promotional offer is as described in the promotional material and is subject to availability.

b. The promotional offer is not transferable and may not be exchanged for cash or any other product or service.

c. Hydraform reserves the right to substitute the promotional offer with an offer of equal or greater value at its sole discretion.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Hydraform, its directors, officers, employees, agents and affiliates shall not be liable for any loss, damage, injury, or disappointment suffered or sustained by any participant as a result of participating in the Sale Promotion or accepting any promotional offer, including but not limited to indirect, incidental, consequential, special, or punitive damages.

8. GENERAL

a. Hydraform reserves the right to amend, modify, or cancel the Sale Promotion and/or these Terms at any time without prior notice.

b. By participating in the Sale Promotion, participants consent to the collection, use, and processing of their personal information by Hydraform in accordance with the Protection of Personal Information Act, 2013 (POPIA).

c. Any disputes arising from or in connection with the Sale Promotion shall be governed by the laws of the Republic of South Africa.

d. Hydraform’s decision on any matter relating to the Sale Promotion is final and binding, and no correspondence will be entered into.

e. These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.

f. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

g. Failure by Hydraform to enforce any provision of these Terms shall not constitute a waiver of such provision.

h. Participants are responsible for any tax implications that may arise from their participation in the Sale Promotion.

i. The promotional offer is subject to the standard Hydraform Terms and Conditions of Sale.
